Is It Illegal to Drive With a Dog in Your Lap? What US Law Says
Share
Short answer: in some states it is specifically illegal, and in almost every state it can get you a ticket if an officer decides the dog is interfering with your driving. Very few laws mention dogs by name, but nearly all of them ban anything that blocks your view or your control of the car, and a dog in your lap does both.
States with rules that name animals
- Hawaii. Hawaii's traffic code (HRS § 291C-124) says no driver may hold an animal in their lap, or in their immediate area, if it interferes with control of the vehicle.
- New Jersey. Animal-cruelty rules have been used to fine drivers whose pets ride unrestrained, with fines reported between $250 and $1,000.
- Rhode Island. Animals must be enclosed, held by another person, or restrained in certain vehicles, with fines up to $200 for repeat offenses.
States that use distracted or careless driving laws
Pet-travel roundups report that drivers have been cited for a dog in the lap under general distracted, inattentive or obstructed-view laws in states including Arizona, Connecticut, Iowa, Maine, Massachusetts, South Carolina and Wisconsin. Washington, D.C. lists interacting with a pet as a form of distraction.
What about Florida, Texas, California, Illinois and Pennsylvania?
These are among the most-searched states, and the honest answer for each is the same: as far as we know, none of them has a law that says "no dogs in your lap". But each has general rules against driving while distracted, with an obstructed view, or without full control of the vehicle. If a dog in your lap causes any of those, you can be stopped and cited, and if it contributes to a crash it can count against you with your insurer.
Laws change and enforcement varies by county. Check your state DMV or highway patrol for the current rule.
Is it illegal for a dog to ride in the front seat?
Generally not, but it's a bad idea. A front passenger airbag deploys with enough force to seriously injure a dog. We explain the options in can a dog ride in the front seat?
Why the lap is the worst spot
- Your dog blocks the steering wheel and your view of the mirrors.
- You can't steer quickly with a dog in your arms.
- In a frontal crash or airbag deployment, the dog is between you and the airbag.
How to keep your dog off your lap
- Give it its own place. A raised dog car seat on the back seat lets your dog see out, which is often why it climbs forward in the first place.
- Clip it in. A short tether to the harness keeps it on the seat but out of the front.
- Start short. Five-minute drives, a treat when it settles. Our 7-day plan walks through it.
